Camia Street Cafe owner sues Cebu City OBO OIC

The owner of a cafe/restaurant in Don Jose Avila Street filed a case against Office of the Building Official (OBO) Officer-in-charge Atty. Jose Marie Poblete before the Office of the Ombudsman-Visayas for violating the Anti-Graft and Corrupt Practices Act.

The case stemmed after Poblete revoked the building permit issued to Adrian Lee.  Lee was issued a building permit last June 21, 2013 and he built a two-storey cafe in his lot.  Last July 2014, the OBO issued a notice revoking the building permit after receiving a recommendation from Cebu City’s zoning board.   Lee argues that his building permit was unjustifiably revoked even if the City Planning Development Office found all his permits in order.

The camp of the owner of the Camia Street Cafe is also filing a separate complaint before the Office of the Cebu City Prosecutor against the city’s zoning board for allegedly tampering with public documents.  The permit revocation was all started when Antonio Lozada, the owner of the lot behind the cafe, inquired to Poblete if the said cafe violated a requirement. Lozada was also the man behind the demolition of a popular Filipino restaurant that used to occupy Lee’s lot.

Lee’s camp contend that the revocation of the building permit will cause him undue injury and his constitutional right to due process was neglected by Poblete as he was not given an opportunity to defend his rights to his own property.
